1. Parties, subject, and acceptance
These Terms of Use govern the relationship between the person using the DietMaxx mobile app and Omer Yildirim, the app developer and provider (the “Provider”).
The user accepts these terms by freely checking the general-terms box for the Privacy Notice and Terms of Use during onboarding and continuing. Downloading or installing the app alone does not constitute acceptance.

2. Service and local operation
DietMaxx is a local-first software tool for calorie and macro planning, meal timing, food logging, hydration, caffeine, sleep, recovery, and digestive wellness tracking.
DietMaxx does not promise central cloud storage, account synchronization, or server-based backup of user data. Core features use SQLite and MMKV storage on the device.

3. Internet-dependent exceptions
Although the app primarily operates locally, internet access is required for Apple App Store or Google Play purchase and subscription operations and for city search and weather data from Open-Meteo.
The Provider is not responsible for temporary unavailability caused by store or Open-Meteo outages, API restrictions, or connectivity problems.

4. Notifications
Local notifications may provide meal, hydration, recovery, and wind-down reminders. Granting, managing, and withdrawing notification permission remains under the user’s control.
Do Not Disturb mode, background restrictions, operating-system behavior, or device settings may delay or prevent notifications.

5. Premium subscriptions and store operations
Premium access is provided through Apple App Store or Google Play. The Provider does not process payment-card details. Renewal, cancellation, plan changes, and refund requests are subject to the relevant store rules.
After changing devices, reinstalling the app, or resetting local data, the user must run Restore Purchases with the same store account. Resetting local data does not cancel a store subscription.

6. Health scope and user responsibility
DietMaxx is not a medical device or a diagnosis, treatment, disease-prevention, or emergency service. Calculations and suggestions are statistical and informational and do not replace advice from a physician or dietitian.
Users are responsible for data accuracy, evaluating suggestions against their circumstances, and consulting a healthcare professional when appropriate. The Health Disclaimer explains these limits in detail.

7. Data loss, availability, and warranty limits
Device failure, loss, theft, deletion of the app, or clearing local storage may cause data loss. The Provider does not guarantee that local data can be recovered.
The app is provided as-is and as available. Uninterrupted operation, completely error-free calculations, or any particular weight-loss, muscle-gain, or health outcome is not guaranteed.

8. Intellectual property and use restrictions
Rights in the app source code, interface, brand assets, algorithms, and original content belong to Omer Yildirim or the relevant licensors.
Except where mandatory law permits, users may not copy or commercially reproduce the app, perform unauthorized reverse engineering, or infringe intellectual-property rights.

9. Changes and governing law
These terms may be updated when law, store rules, or app functionality changes. New users accept the current version during onboarding, and the current text remains available in the app and on the public legal-policy page.
Subject to mandatory consumer protections, the laws of the Republic of Türkiye apply.
